Part 1

Part 2

Part 3

This three-part series is designed for ethics officials and others who have limited experience or familiarity with the statutory waiver authority at 18 U.S. Code (U.S.C.) 208(b)(1). Part 1 provides an overview of the statutory waiver authority and discusses the role that agencies and OGE play in the process from drafting to issuing individual waivers under 18 U.S.C. 208(b)(1). Part 2 provides guidance and sample language for organizing and drafting complete waivers that meet the statutory requirements, and Part 3 outlines the process to follow when a drafted waiver is ready for OGE to review.

Note: On July 18, 2024 OGE issued Program Advisory (PA)-24-03 about a new practice of listing information about individuals granted certain conflict of interest waivers.
